At a time when Albania is advertising to donors and the European Union that it is accelerating its energy transition, the Energy Regulatory Authority (ERE) has turned solar power licenses into an instrument of financial speculation. What should have been a reform towards sustainable sources is turning into a scheme to enrich a small circle of politically connected businessmen, with the tacit blessing of the government and a total lack of accountability.

The ERE has granted over 64 licenses for photovoltaic plants by April 2025. Almost all for small projects, under 2 MW, with a guaranteed power purchase price of 95.04 euros/MWh. This scheme, designed to encourage real investment, has turned into a market for resaleable permits, where applicants do not build anything, but simply wait to sell the permit to a larger operator, at a profit premium.

This is not energy development. It is permit trafficking. This process began as an innovative step by the Ministry of Infrastructure to accelerate the development of renewable energy in accordance with EU directives. But, in the absence of proper control by the ERE, it quickly turned into a scheme distorted by the regulatory entities themselves. Instead of filtering applications according to real capacities, the ERE and its structures have abused the right to grant licenses, paving the way for speculation, clientelism and money laundering.

The latest case of the 834-hectare project in Kanina is new evidence of land grabbing for undeclared energy interests. Despite opposition from residents and concerns about the disappearance of the area’s livestock economy, the Municipality of Vlora is being pushed towards approving an agreement with shady terms, suspected of being directly lobbied by an oligarch close to the government. According to media sources, Prime Minister Edi Rama himself has been pressuring the Mayor of Vlora to move forward with the land allocation procedures, despite community opposition and a lack of transparency, directly forcing the local institution to proceed against the public interest.

The names that dominate the license register are the same.

Gerian Kuke is involved through entities such as AGE Sunpower, SONNE and AED Solar. He has received some of the most favorable permits and is considered one of the most aggressive beneficiaries of the scheme. His name is constantly mentioned in related applications, and his associates are active in the informal market for selling licenses.

Në mungesë të kapaciteteve teknike, financiare dhe përvoje në sektor, leja e dhënë për “Alb Sun Energy” është një provë e qartë e degradimit të standardeve të ERE-së.

Të gjitha këto struktura i shërbejnë të njëjtit qëllim: përfitimit të licencave 2 MW përmes mekanizmave të thjeshtëzuar dhe për t’i pozicionuar ato si asete për shitje. Kapllanaj, një ish-kryetar bashkie dhe figurë politike, është shembulli klasik i ndërthurjes së pushtetit lokal me përfitimin ekonomik.

Familja Leskaj, përmes strukturave si SPV Blue 1 dhe Blessed Investment, ka përfituar një park 50 MW që ndodhet në letër. Projekti ka kaluar në ankand, por nuk ka progres të raportuar në ndërtim. Edhe pse ky është një projekt më i madh, mungesa e aktivitetit pas dhënies së licencës ngre pikëpyetje për seriozitetin e implementimit.

Kail Energy, përfituesja kryesore e 4.3 milionë metër katrorë tokë publike në Bashkinë Kolonjë, është një kompani pak e dokumentuar në publik. Mungon transparenca për strukturën pronësore dhe kapacitetet reale të saj. Vetë fakti që një kompani e panjohur merr një sipërfaqe të tillë pa garë, është tregues i një vendimmarrjeje të njëanshme dhe të dyshimtë.

X One është kompania që ka përfituar më shumë tokë publike në Shqipëri për projekte fotovoltaike – mbi 5.5 milionë m² në Bashkinë Poliçan. Kjo kompani nuk ka aktivitet të njohur në fushën e energjisë dhe nuk ka kryer asnjë ndërtim real. Tokat janë dhënë me qira në procedura të mbyllura, pa transparencë dhe pa konkurrencë.

Shumë nga këta operatorë nuk kanë as histori prodhimi, as përvojë teknike në energji. Ajo që i bashkon është marrëdhënia me shtetin, kapaciteti për të marrë tokë publike nga bashkitë dhe qasja në ERE për të siguruar leje. Përfitimi nuk qëndron tek ndërtimi i centraleve, por tek posedimi i një licence që nesër mund të shitet.

Të dhënat e Open Data Albania dhe analiza e Citizens.al ka zbuluar se mbi 1,550 hektarë tokë publike janë dhënë me qira nga bashkitë për ndërtim të parqeve fotovoltaike – në të gjitha rastet pa garë. Bashkia Poliçan i ka dhënë kompanisë X One mbi 5.5 milionë m2. Bashkia Kolonjë ka shpërndarë 4.3 milionë m2 për 12 kontrata të ndryshme, ku dominon kompania Kail Energy.

All these procedures carry the „Red Flag“ classification for lack of competition. So, we are dealing with clear favoritism, which serves as the basis for applying to the ERE for a license. In no case has the ERE refused to grant a license for lack of competition in the basic land contract.

Except for Karavasta Solar and Ersekë Solar Park, most of the licensed projects have not started construction. Voltalia has started construction in Spitalë at the end of 2024. Dozens of 2 MW parks exist only on paper.

ERE has the obligation to monitor the implementation of construction deadlines. But it has not published any decision to revoke licenses against entities that have not started work within the stipulated deadlines. This institutional tolerance turns permits into an instrument of enrichment for those who receive them, without any cost and without any obligation.

Edi Rama continues to advertise the increase in solar energy capacities at international tables. In reality, they are capacities on paper. On the ground, photovoltaic energy production is many times lower than the licenses granted. But this is not mentioned in government reports.

The Prime Minister has no reaction to the abuse of public land. There is no comment on the lack of competition. Nor on the lack of control of licensed projects. Instead, he relies on the “successes” of Voltalia to cover up the systematic failures of Albanian institutions.

Beyond speculation in licenses and the grabbing of public land, the photovoltaic energy sector has also become a sophisticated tool for money laundering. Companies that do not produce anything real, but hold permits on paper, are being used as conduits to legalize income from illegal activities through simulated investments. Banks, on the other hand, have offered financing without in-depth analysis of the risk or the real ability of the operators to build and operate the plants. This has given this scheme a kind of formal legitimacy, creating a circle where dirty money passes in the form of “green investments”.

Solar energy licenses have become a financial asset, in the hands of a closed circle of individuals. ERE does not exercise control. The Prime Minister does not take responsibility. While the public remains uninformed about how state land, the budget and natural resources are being used.

In stark contrast to this situation, European Union countries have set clear standards for granting licenses in the renewable energy sector. In Greece and Italy, failure to meet deadlines automatically results in license revocation. In Germany and the Netherlands, regulatory authorities have very strict verification systems for the financial and technical capacity of applicants, and follow the principle of total transparency in the publication of contracts and final beneficiaries. Meanwhile, in Albania, the lack of any real filter has led to a situation where licenses are granted as consumer goods, without control and without consequences. /Pamphlet

Alle Familien, die einen Vertrag mit OSHEE für Energie und mit FSHU für Wasser haben, sind keine Schuldner, also haben sie ihre Rechnungen bezahlt und ihr Haus legalisiert, werden mit Mitteln aus dem Staatshaushalt für die Installation von Wassersystemen unterstützt ihre Häuser.

In der letzten von der Regierung genehmigten Entscheidung heißt es: „Die Investitionsförderung wird in jedem Fall nur einen Teil der Kosten decken, die für den Kauf und die Installation von Technologien, die erneuerbare Energiequellen nutzen, für die Realisierung von Heizung und Kühlung erforderlich sind.“ .

Gemäß der Entscheidung wird es vier Vorhaben geben, die vom Staat finanziert werden. Wenn Familien die Installation von Solaranlagen zur Warmwasserbereitung beantragen, erhalten sie eine Finanzierung in Höhe von 70 % des Investitionswerts, also 140.000 ALL, während die Finanzierung für Biomasse- oder Biobrennstoffkessel 20 % des Investitionswerts oder mehr beträgt bis 250.000 ALLE. Diejenigen, die Luft-, Wasser- oder Erdwärmepumpen installieren, erhalten eine Finanzierung in Höhe von 20 % des Wertes oder bis zu 600.000 ALL, und das letzte Programm für Zentralheizung und Kühlung in staatlichen Wohnungen deckt 30 % des Investitionswertes oder bis zu 3 % ab Millionen ALLE.

In der Entscheidung sind auch die Unterlagen aufgeführt, die die Familien, die diese Unterstützungsmaßnahmen beantragen, vorlegen müssen:

a) Benachrichtigungsschreiben (Personalausweis);

b) Familienzertifikat;

c) Eigentumsbescheinigung;

ç) OSHEE/ FSHU -Rechnungen oder Rechnungsbestätigungen für mindestens die letzten 12 (zwölf) Monate;

d) Einkommensnachweis für jedes Familienmitglied;

dh) Bescheinigung, dass der Abonnent kein Schuldner gegenüber OSHEE/FSHU ist;

e) Für bedürftige Verbraucher eine Bescheinigung des für soziale Angelegenheiten zuständigen Ministeriums, dass der Abonnent zu dieser Kategorie gehört;

ë) Das Projekt und die Beziehung, die von einem Ingenieur durchgeführt werden, der mindestens gemäß Kategorie 4.b des Beschlusses Nr. 759/2014 des Ministerrates „Über die Berufslizenzierung von natürlichen und juristischen Personen, die eine Tätigkeit in der Branche ausüben werden“, lizenziert ist Fachgebiet „Entwerfen im Bauwesen“ und Überwachung der Genehmigung von Ausführungsarbeiten im Bauwesen“, geändert“, zusammen mit der Erklärung über die berufliche Verantwortung und der entsprechenden Lizenz. Dieses Dokument kann nur für Solaranlagen zur Warmwasserbereitung ausgenommen werden;

f) Je nach Fall wurde die Genehmigung für die Durchführung der Arbeiten unter Bezugnahme auf die Bestimmungen des Beschlusses Nr. 408 vom 13.5.2015 „Über die Genehmigung der Gebietsentwicklungsverordnung“ geändert.

In der Entscheidung wird klargestellt, dass es die Agentur für Energieeffizienz sein wird, die Ausschreibungen für Wirtschaftsteilnehmer öffnet, die diese Geräte anbieten, die von den Bürgern installiert werden, und dass dann die Familienverbraucher, die zu Gewinnern dieser Programme erklärt werden, eines davon auswählen bei der Agentur registrierte Themen.
