      Helmuth Lohan, the EU’s ambassador to Tirana, said economic progress in Albania had suffered because of fuzzy ownership titles affecting almost all families and eroding citizens‘ confidence in democracy and the courts.
      „Clear property titles and legal security are essential prerequisites for the prosperous development of the country, the attraction of foreign direct investment, social peace as well as for the country’s European integration process,“ Lohan said.
      Successive conservative and leftist governments since Albania toppled Communism have tried with little success to return property to rightful owners who were expropriated after World War Two by the late Stalinist dictator Enver Hoxha.
      Rural land has been distributed to those living on it while real estate in cities has been returned to pre-war owners, but the process has been marred by red tape and corruption, resulting in multiple registration of property titles.
      Prime Minister Sali Berisha has played down the problem, saying it has not prevented foreign investors from buying up cheap land.

TOURISM SUFFERS

      Lohan said tourism along Albania’s Adriatic and Ionian Sea coasts, one of the country’s main sectors for economic development, was a victim of the uncertainty.
      A planned Club Mediterranee resort has been delayed for five years because of unresolved property and access issues, forcing Club Med to put the project on standby.
      „Many interested investors have visited the Albanian coast after identifying its potential long ago. However, actual investments in tourism remain highly fragmented and minimal, precisely because of unresolved property issues,“ Lohan said. He added that disputes over ownership had not only caused violence and even deaths, but also led to courts becoming tied up with property cases that take many years to be resolved. Disheartened by their own courts, many Albanians have complained to the European Court of Human Rights at Strasbourg, which has ruled in their favour, asking Albania for compensation.
      Edlir Vokopola, head of the Urban Research Institute, said numerous changes to the laws governing arable land and real estate had made the restitution process and the clarification of rightful ownership even more difficult.
      „This is the last time the train can stop at this station and we need to catch it, otherwise it will be much more difficult,“ said Vokopola, a former head of the state property registration office.
      He said the Albanian state itself had failed to register as its own asset 50,000 hectares (124,000 acres) of land it owned at the end of World War Two, with the result that it owns much less today.
      Deputy Economy Minister Eno Bozdo said Albania acknowledges the problem. „Unfortunately, it cannot be solved in the next few years,“ Bozdo added. (Editing by Adam Tanner and Mark Trevelyan)

September 2005 – After the government cabinet was created, Berisha annuls the privatisation of Albtelekom. “We can not sell it on low price”, he said on “Calik” company offer. Some months later, he “gave” Albtelekom to turkish company.

June 2006 – Sali Berisha’s nephew, Dritan Berisha, employed in Interior Ministry creates an incident with fire arms in front of hotel “Dajti” in the center of Tirana.

September 2006 – Director of Civil Aviation, Gazmend Dibra resigns after the scandal “Albatros”, a flying company where one of the share holders was nephew of President Alfred Moisiu. February 15 2007 – Another scandal, road Levan-Vlore was given to “Alpine” company. The company is managed by sister-in-law of Fahri Balliu, member of national Council of DP and publisher of “55” newspaper. Manager of “Alpine” was General Secretary of Ministry of Culture.

April 25 2007 – Some days before the visit of US president George W.Bush in Albania, after a quarrel with Premier Berisha, Ministry of Foreign Affairs Besnik Mustafaj resigns.

May 2007 – Government initiates the approvement of law “On Taxes Procedures in Republic of Albania” , considered as “Fine Law”. Bussiness’s representatives and opposition were against the law and that ended up in Constitutional Court.

June 2007: Scandal of school “Omiros” in Korça was published. Ministry of Education approved a history text for this school, deformating the history of Albania.

July 15 2007 – Government fines Top Channel with 13 millions of euros for fiscal evasion. Two years later, government penalizes also NEWS 24 television with 8 millions leks, after broadcasting a TV spot of G99.

July 18 2007 – Turkey blocks 60 arm conteniers from Albania with destination Armenia. Arms’ bussiness caused a diplomatic scandal when Azerbaidjan requested to Islamic Conference to penalize Albania. Armenia was in conflict with Azerbaidjan at that time.

August 29 2007: The fourth worker died in the mine of Bulqiza. The mine was closed to improve conditions but was never opened again.

18 shtator 2007 – Corruption with road’s tenders. Deputy minister of Transport, Nikolin Jaka, ex-director of Roads, Ilir Berzani and 7 high officials were arrested. They demanded bribes for tenders from private companies.

September 28 2007 – A secret contract of Premier Berisha with Tom Ridge on a value of 500 000 dollars was published. High Council of Justice accused Premier of breaking the law with this secret contract.

October 9 2007 – The biggest scandal of this government, road Durrës-Kukës, was published. Prosecution begins investigation and this brings to lift of immunity to Lulzim Basha. According to High Council of Justice, there are abuses of 232 millions of euros.

November 1 2007 – Lulzim Basha, Minister of Foreign Affairs demands a change in the mandate of OSCE from interference to expertise. OSCE answers: We want to stay and we’re against the change in mandate.

November 6 2007 – Parliament votes to dismiss General Prosecutor, Theodhori Sollaku. The dismissal was supported by 77 lawmakers, 36 were against and 3 abstained.

November 14, 2007 – Director of Prisons, Saimir Shehri resigns. He accused brother of Minister of Justice, Ilir Rusmali, for tentatives of corruption for a tender in the Directorate of Prisons. One day later Rusmali resigns too.

December 7, 2007 – Transparency Internacional publishes the report on corruption in Albania; health care and justice system are the worst sectors. Around 80 % of albanians have no trust in albanian government.

February 10 2008 – The dossiers of “Argita Berisha”, daughter of premier Sali Berisha opens up. Her legal studio was swept up by the national register, while it is verified fiscal evasion on her activity.

March 15 2008 – The biggest corruption scandal of Albanian government, Gerdec, erupts. The bussiness of MEICO and Albademil was very lucrative, but the explosion in Gerdec on this day kills 26 and injures 300 persons. Three days later, Minister of defence Fatmir Mediu resigns. Director of Meico Ylli Pinari, owner of Albademil, Mihal Delijorgji and director of the facility, Dritan Minxolli, were arrested.

March 28 2008 – “New York Times” publishes the article on the bussiness of arms from Albania to Afghanistan. MEICO is involved in the traffic. Ylli Pinari, director of MEICO contacted with Efraim Diveroli, owner of AEY that won a contract from Pentagon to supply the Afghan army with ammunition. In the scandal it was involved also the son of Premier Berisha, after a registered conversation between Kosta Trebicka and Efraim Diveroli.

April 2 2008 – Albanian government puts under pressure the prestigious “Financial Times” for a special editorial in change of state advertisement from ministries. The newspaper refused this.

April 8 2008 – Government pays 300 000 euros for a turistical spot in CNN.

May 5 2008 – Arben Sefgjini, Director of Taxes in Berisha administration is dismissed. He was accused of liquidation of the albanian-macedonian bussinessman Remzi Hoxha.

June 16 2008 – DP majority drops candidatures of Bamir Topi for the members of Supreme Court. This caused the reaction of international community, USA, OSCE an CoE against government’ interference on independent institutions.

July 23 2008 – Banal and arrogant insults of Premier Berisha against lawmaker Taulant Balla during a parliamentary session. This sets a precedent of insult and threats in the parliament.

August 2008 – Government prepares the Law on Prosecution. US reacts: These are pressures to put prosecution under control.

August 2008: “Gazeta Shqiptare” in Lazarat. NEWS 24 films cannabis plantations watered by statal water-tanks. Government and police won’t admit their failure.

August 26 2008 – 1 kilo of cocaine is found in the car of Albanian Ambassador in Italy. Police arrests Arsen Selmanllari, driver of ambassador Llesh Kola. Arsen Selmanllari is cousin of Rahman Selmanllari, close friend to Shkëlzen Berisha, premier’s son.

September 2008 – Bussinesman Kosta Trebicka is found dead in misterious circumstances. He was the first to denounce the corruptive affair of Gërdec and the arms’ traffic from Albania to Afghanistan. Investigations concluded in a “accidental death”.

October 5 tetor 2008 – Damir Fazlliç is arrested in Sarajevo. He had created the company SRF Developments in Albania and its administrator was Erjon Isufi, brother-in-law of Foreing Minister Lulzim Basha. Co-partner of Argita Berisha, Flutura Kola bought from Fazllic a company of 1.7 millions of euros for Crown Acquisitions. Prosecutors were not allowed to ask questions to Damir Fazllic. He went away from Albania with the help of police.

February 23 2008 – Government hunts out IMF from Albania. On 1996, IMF left Albania in a demostrative manner. It was the moment of collapse of pyramidal schemes. Sali Berisha was president and Ridvan Bode was Finance Minister. The same person commands now state finances.

October 26 2008 – Government initiates the approvement of a new law “On Territory”. This project caused scandal in World Bank offices and CoE offices: Government is breaking the autonomy of local government!

December 16 2008 – “Law of Spies”; Berisha accuses Zamir Shtylla, head of investigations in General Prosecutor as a communist investigator. Shtylla resigns from his post. He was investigating important cases as Gerdec, Fazllic and Durrës-Kukës road.

January 29 2009 – A scandal of properties in “Plazhi i Gjeneraleve”, near Tirana implicates also the head of DP parliamentary group Astrit Patozi.

February 2009 – “Jala”scandal implicates the son-in-law of Premier Berisha, Jamarbër Malltezi. The scandal that caused hot debates and polemics is about the demolition of several houses in Jala, on the arguments that a World Bank project would be implemented there.

April 3 2009 – Minister of Turism and Culture, Ylli Pango was involved in a sexual scandal. “Fiks Fare” programme in Top Channel broadcasted the scandal images and four minutes later, Premier Berisha dismissed him.

April 29 2009 – Greek Premier Kostas Karamanlis in Tirana meet with head of state and government. Berisha and Karamalis signed the agreement on “coastal line”, considered as a scandal and kept secret by government.

May 12 2009 – Argita Malltezi, daughter of Premier interfered in statal institutions to secure a permission to construct an energetic parc in the territory bought from the family friend, Damir Fazlliç. In the confidential emails of Argita Malltezi and aran citizen Zafar Ansar on the issue, it was discussed also her interference in several institutions.

    Druck über den Geldhahn

    Ohne Rechtsstaatlichkeit keine wirtschaftliche Entwicklung. Ohne Rechtsstaatlichkeit keine dringend notwendige Aufarbeitung der konfliktreichen jüngeren Vergangenheit. Es zeugt leider nicht von funktionierender Rechtsstaatlichkeit, wenn Kosovo sein Sondertribunal zur Untersuchung von Verbrechen der kosovo-albanischen Befreiungsarmee UÇK mit europäisch-amerikanischer Hilfe außerhalb der Landesgrenzen abhält. Das Kosovo hängt stark am ausländischen Geldhahn. Das sollte ein probater Hebel sein, um von der Regierung Rechtsstaatlichkeit im eigenen Land zu fordern.

    Hier kommt die zweite Leitlinie in Spiel: EU und USA müssen einig sein. Andernfalls werden wir gegeneinander ausgespielt. Manchen politischen Akteuren in der Region ist gar zuzutrauen, dass sie bewusst ethnische Konflikte provozieren, um durch einen weiteren gewalttätigen Konflikt den westlichen Geldhahn wieder zu öffnen. Gegen solche Methoden hilft nur geschlossenes Auftreten.

    Die Konsequenz aus einer Hinhaltetaktik und Nichteinhaltung des Versprechens wäre der totale Vertrauensverlust bei Bevölkerung und politischen Eliten des Westlichen Balkans.

    Für die dritte Leitlinie müssen wir in unseren eigenen Parlamenten streiten, um außenpolitisch mit einer Stimme zu sprechen. Unser Beitrittsversprechen muss absolut verlässlich und glaubwürdig sein. Die Konsequenz aus einer Hinhaltetaktik und Nichteinhaltung des Versprechens wäre der totale Vertrauensverlust bei Bevölkerung und politischen Eliten des Westlichen Balkans. Das Beispiel haben wir vor Augen: Die antieuropäische Argumentation der pro-russischen Ukrainer sollte als Signal ausreichen.

    Es bleibt die Frage, mit welchem „Dann“ wir argumentieren können, wenn Bedingungen nicht erfüllt werden. Wir wollen die Länder des Westlichen Balkans ja in der EU haben. Wir wollen – wie von Frank-Walter Steinmeier in Sarajevo angekündigt – den „Compact for Growth“ begleiten. Die Beitrittsperspektive zu entziehen ist keine Option. Eine politische sinnvolle Option ist hingegen der rigide Umgang mit finanzieller Unterstützung. Daher ist es richtig, dass Bosnien 2014 deutlich weniger Mittel aus dem Instrument für Heranführungshilfe (IPA) erhält als bisher und dass der Internationale Währungsfonds (IWF) seine Tranchenzahlung an die Republika Srpska aussetzt. Noch effektiver dürfte die Verknappung von Budgethilfen wirken. Von diesem Kanal profitieren auf Umwegen nämlich auch Parteien. Nur wenn diese die neuen Bedingungen zu spüren bekommen, kann das Wenn-Dann-Schema funktionieren.

    Natürlich ist es im Sinne von Planbarkeit unumgänglich, dass Mittel nicht sofort wieder entzogen werden können. Die Aussage muss jedoch gelten: Unsere finanzielle Unterstützung wird unglaubwürdig, wenn sich in den Gesellschaften die substanziellen Probleme nicht ändern. Dann heißt es von der Bevölkerung: „Die EU überweist Geld an unsere Politiker, unsere Gesellschaft bleibt genauso undemokratisch wie bisher und am Ende kommen wir nicht einmal in die EU.“

    Beim Europäischen Rat am 27. Juni könnte Albanien den EU-Beitrittskandidatenstatus erhalten. Das wäre jetzt der richtige Schritt. Damit schafft die EU Vertrauen in ihr Versprechen aus Thessaloniki und kann anschließend nach strikter Konditionalität weiterverfahren.

    Der Westliche Balkan liegt mitten in Europa. Seine Stabilität sollte uns aus ureigenen und solidarischen Interessen sehr am Herzen liegen. Diese Botschaft ist noch nicht überall angekommen. Als Parlamentarier wünsche ich mir dazu einen Dialog mit Kollegen aller Parlamente der EU. Wir können diese Diskussion nicht nur in Deutschland führen.

    Albania for $ale: With a Little Help from Her ‘Friends’

    Last February, virtually lost in the media attention over the Kosova crisis, a ceremony was held at the U.S. Department of Commerce in Washington, DC. Commerce Secretary William Daley looked on while then Albanian Prime Minister
    Pandeli Majko and Dr. Chirinjeev Kathuria, the president of a Chicago-based company known as
    New World Telecom, signed an agreement to establish a joint venture between New World and Albtelecom, Albania’s state-owned
    telecommunications firm. The objective of this deal was to establish an exclusive joint venture for the development of a $300 million wireless telecommunication system in the Republic of Albania.

    The press releases were quite impressive – “U.S. telecom company to invest $300 million dollars in Albania.” My first reaction was, “who is New World Telecom?” But at that time, like most Albanians, I was preoccupied with the Kosova conflict, so New World faded from my radar screen.

    I have requested investigations of this matter by Senator McCain’s and Senator Helm’s offices as they have oversight responsibility for the Commerce and State Departments, respectively. As a result, Senator Helm’s office
    forwarded information to me about New World Telecom. These documents, which consisted primarily of self-serving press releases, had been submitted to the Senate Foreign Relations Committee by the Commerce Department because of my
    inquiry. After reviewing this material I wrote to Secretary Daley as follows:

    “In my opinion, there was one thing missing from this promotional material ñ evidence that New World Telecom has ever successfully completed the turn-key development of a telecommunication project anywhere in the world. If my interpretation is correct, then it appears that the Commerce Department, knowingly or unknowingly, influenced the government of Albania to entrust the development of its telecommunication system to, in the best case, a fledgling company.

    So I continued to press the Albanian and American government officials to provide me with rationale for promoting New World in Albania. To no avail, I requested a meeting with representatives of the Commerce and State Departments and New World Telecom to discuss this matter. I also requested meetings with President Meidani and Prime Minister Majko during their recent
    visits to the United States to discuss New World Telecom, but they were too busy. …But I can appreciate their reticence to see me – it’s quite obvious they didn’t want to hear what I had to say.

    After repeatedly badgering the State Department to justify their support of New World Telecom, in October I received this e-mail message from a State Department official:

    In the fall of 1996, I warned the Berisha government that if they did not bring an end to the pyramid schemes that “it was not a question of if, but when” they would collapse. At that time I also warned the Albanian government that if they did not take action, and if the pyramids collapse of their own weight, that “large scale civil unrest with ensue.” In retrospect, Berisha’s
    failure to heed my warnings and those of others had devastating results for the Albanian people and the Balkans when Albania exploded into anarchy in 1997. Can Albania afford another economic debacle?

    I suggest that the Albanian government ponder the words of James Hendrix, “castles made of sand, fall into the sea – eventually.”

    Mr Mane left Korce in south Albania in 1991 to study geology in Vienna. He spent less than a year at university – “basically I learned German there” – before setting up his own company to sell

    Wholesale prices were cheap because Austria was the centre for exporting white and brown goods to eastern Europe, offering entrepreneurs such as Mr Mane an opportunity to earn high profits. “To keep down transport costs, we’d put a dozen items on the bus to Tirana,” he says.

    Neptun, his Vienna-based consumer electronics business, has 21 outlets in Albania, Bosnia-Hercegovina, Kosovo, Macedonia and Serbia.

    His next retailing venture was Euromax, now the biggest Albanian supermarket chain and preparing to expand in Bosnia alongside an international partner. The EBRD is an investor, providing €9.5m ($14.8m) in debt and equity financing.

    Two years ago, Mr Mane opened Qendra Tregtare Univers, the country’s first shopping mall.

    His businesses have more than 1,200 employees, including senior managers from Canada, Greece and India. He plans to invest €46m to build another QTU mall in Tirana, which will include an entertainment complex with a six-screen cinema. “We intend to have malls in every Albanian city with more than 100,000 residents, and a small one in Korce because it’s my home town,” he says.

    All the malls will include a Euromax hypermarket. “We’re building islands of European quality in what’s still very much a developing market,” Mr Mane says.

    “It made a huge difference being able to see foreign films in a comfortable environment,” he says.

    Construction is under way on the first project, the American Business Centre, located in the Blokk, a mixed residential and commercial district where the communist elite used to live. Gleeds, an international construction management consultancy, is project manager.

    “We need some imaginative new architecture to define the 21st century capital, but we have to make sure we build to European Union standards,” Mr Xhillari says.

    Outside the capital, he has launched a €20m ($31m) project to convert the former summer palace of King Zog, an art deco building on a hilltop above Durres with a spectacular view over the Adriatic, into a small luxury resort.

    The news about the astonishing – and deadly – cost-overrun problems associated with Boston’s „Big Dig“ and the fact there are Massachusetts Senators who are actively seeking to ban Bechtel from doing any future work in their State are revelations that raise very serious questions about Sali Berisha and Lulzim Basha’s handling of the Durres-Morina road building affair.

    There can be no question that the construction of a major road artery is a crucial part of Albania’s economic development. However, because of the importance of this project to Albania’s future, the Albanian government was obligated to complete whatever due diligence was necessary in the process of selecting a contractor for this monumental task.

    A major part of the problem is that neither Berisha nor Basha has any experience with a project of this magnitude. To exacerbate the problem, instead of realizing his limitations, Berisha refuses to listen to others and prefers to fly by the seat of his pants using his own highly flawed instincts. The same instincts that have proven disastrous for Albania in the past, as Albanians learned the hard way with Berisha’s pyramid schemes. To make matters worse, Berisha is eager to please certain foreign centers of power solely for the purpose of advancing his own selfish agenda. As for Basha, he is little more than a foolish and pompous stooge who is barely out of his diapers and still dangles from the strings held by Berisha. So what we have here is a classic case of the blind leading the blind on a project that has the potential to bankrupt Albania.

    Did Berisha and Basha contemplate the history of Bechtel’s problems with other major infrastructure projects like the $1.1 billion cost-overrun on the Bid Dig? Did they question Bechtel and include provisions in the contract that would protect Albania from the type of cost-overruns experienced in Boston? Of course Berisha and Basha can now say they took this all into consideration, but if they attempt a cover-up, they can’t just say they were aware of these problems, they need to prove it by producing solid evidence, including correspondence, emails, and legal briefs, that would substantiate any claims they may make that this was all thoroughly addressed. Also, who advised or pressured the Albanian government on moving forward with Bechtel? We now know, as a result of the denial issued by Camile Nuamah, head of the World Bank’s Tirana office, that Basha’s effort to cast blame on the World Bank was a blatant lie. It should be noted that by wrongfully implicating the World Bank in this underhanded attempt to cover his mistake, Basha has potentially damaged Albania’s relationship with the World Bank, the institution that has been most instrumental in helping to stabilize Albania’s economy, and this alone should be grounds for his termination.

    Was the Bechtel contract just a back room deal agreed to by Berisha and Basha? If they claim not, was there an extensive team of international consulting engineers, legal advisors and other experts helping Albania to maneuver such treacherous waters? Or was this too practical of an approach to expect from Sali Berisha because his modus operandi does not include rational decision making?

    Now, in light of Bechtel’s numerous debacles on other projects, the issue of the lack of transparency in the selection of Bechtel and the fact there was no open international tender for Albania’s massive Durres-Morina project is beyond comprehension. Especially when one considers that, with any miscalculations or unanticipated construction costs, we could be talking about a difference of hundreds of millions of dollars in the final cost of the project – money Albania cannot afford to lose. Despite the campaign lies that flowed from Berisha’s mouth about greater transparency, the probability of seeing Berisha govern with open, rational, professional conduct is lower than the odds of seeing the sun fall from the sky and into the Adriatic Sea. Berisha’s duplicitous handling of the Albtelecom scandal is a perfect example of the skullduggery that has come to symbolize his regime. And the Bechtel matter is just more of the same.

    In an example for his lack of respect for the people he governs, Berisha had the audacity to insert his son, Shkelzen, as a manager at Albtelecom, an absolute conflict of interest for a head of government, particularly in a country facing such high levels of unemployment and poverty as Albania. As you will recall, this is the same type of dirty game Fatos Nano played with his own son at Vodafone, the same Fatos Nano who Berisha once accused of corruption for displaying similar behavior.

    Bechtel has no monopoly on the engineering prowess required to complete the Durres-Morina road building project (see ENR list of top global contractors. There are global engineering behemoths who compete with Bechtel on projects of this scale everyday. To be sure, there are other companies that, in addition to possessing engineering qualifications that rival those of Bechtel, may have been able to offer government subsidized financial incentives that were not available in the Bechtel deal. I am well aware that if one digs deep enough, it is likely many of these companies may have experienced scandals of their own, but Berisha and Basha had the absolute responsibility to the people of Albania to do everything within their power to assure they hired the most qualified firm to complete the Durres-Morina project, and this company should have provided the strongest possible guarantees of completion at the lowest possible price inclusive of financial incentives. As has now become clear, this due diligence was not done, and in my opinion, this constitutes a criminal act.

    Prime Minister Sali Berisha

    Both Berisha and Basha should immediately stop hiding behind immunity and open themselves to voluntary interrogation on this matter. If not, it is time for the Berisha government to come to an end.

    Being a doctor, Berisha knows well that when a cancer is discovered in the body it must be treated promptly and aggressively, with surgical removal if necessary. With this in mind, Berisha and Basha should be viewed as little more than cancers growing on Albania and must be treated accordingly.

    Wake up Albanians! It’s time for another change!

    Time Warner and Albania

    Time Warner recently introduced its „International OnePrice“ calling program to American customers. For $19.95 per month this calling plan allows Time Warner customers unlmited international calling to over 100 countries.     Interestingly, there is one country that is noticeably absent from the list of countries included in the Time Warner plan. Can you guess which country? I’ll give you a hint: the country has a red flag with a black double-headed eagle. If you guessed Albania you guessed right. Do you know why? It’s because the biased and abnormal pricing agreements that exist among Albania’s telecoms do not make it economically feasible for Time Warner to include Albania in the plan. This is the same reason Albanians are forced to endure what are among the highest calling rates in the world for their own telephone usage in Albania.

    I have repeatedly called for investigations of these interconnection agreements and so have others. But investigations have gone nowhere.

    Lulzim Basha

    Instead, when then Minister of Telecommunications Lulzim Basha was called to testify before a committee that was seeking answers to questions about these schemes, he repeatedly ignored the requests and never testified. As for Berisha, when he was in opposition, he sought my assistance to help focus attention on these schemes. But now that he has regained power, he has lost interest in prosecuting an investigation of telecom pricing in Albania. Why? Could it be that now that he is back in power he is in the position to take personal advantage of the same financial incentives that caused Fatos Nano to ignore this matter? Just click on the link below for Rilindja Demokratike, Berisha’s pathetic excuse for a newspaper, and you will note along the right hand side of the front page that one if its most prominent advertisers is none other than the Greek owned wireless carrier AMC.

    So that it is clear, because of these biased telecom interconnection agreements, Albanian consumers continue having their pockets picked by the wireless carriers, like Greek owned AMC, whenever they pick up their phones to place calls. Those who place international calls into Albania are raped in a similar way. And it is with these ill-gotten gains that AMC is able to spend millions of dollars on advertising to silence criticism from Albania’s media and buy the cooperation of corrupt hajdut Albanian „leaders“ like Sali „Enver“ Berisha. And while Lulzim Basha is parading around the U.S., he should elaborate on his own relationship with Greek owned AMC and respond to the allegations that he has accepted bribes from them. Basha should also asked ro explain why he refused to attend before the Parliamentary Commission to provide his testimony. This investigation went nowhere because since coming to power, the Berisha government has gone out of its to undermine any attempt to investigate Albania’s rigged telecom sector. Just as the Nano government tried to hide the ITU report and block investigations while it was in power.

    As everyone in Albania will recall from his election campaign, Berisha promised that he would stop the Albtelecom deal and there would be a thorough investigation of this transactioin. I pesonally provided information to his staff that should have helped them prove the exsistence of a bid-rigging conspiracy, but I would not hold my breath waiting for them to take such action because this would require biting the hand that feeds them. As I predicted long ago, just like Berisha has forgotten his concern about the abuses with telecom interconnection agreements, he has forgotten his promises about Albtelecom. Instead, he allowed the Turks to steal Albtelecom for the same price negotiated by Fatos Nano – a price that several telecom financial experts estimated may be $200 million below its value. In fact, German telecom investor Axos offered to buy Albtelecom for more than $300 million! Why would Berisha do this? According to some speculation, it’s because the Turks knew they were getting the deal of the century and were willing to make payments under the table to preserve the deal and guarantee that they got it at a bargain basement price. And who received these payments? It’s alleged they were shared by Fatos Nano, Sali Berisha and Genc Ruli. As many of you will recall, Ruli is no stranger to charges of corruption.

    I call upon Attorney General Sollaku to aggressively more forward with his investigation of Albania’s telecom industry. It is time to put an end to the abuse of the people of Albania at the hands of the Greek wireless carriers and those corrupt Albanian politicians who care only for the good of their own pockets, not the welfare of the people of Albania.

    Last September, I placed two international calls to Albania from my Verizon land line telephone in New York. One of my calls terminated in a mobile system and the other in a land line system, but both calls were billed to me by Verizon at identical rates of $5.26 per minute.


    It is my understanding that the rates for calls from the U.S. to Albania are among the highest in the world. As a U.S. citizen, this is highly disturbing because I have reason to believe these rates have been artificially inflated as a result of market manipulation, collusion and price fixing between the Albanian government officials who control Albtelecom, the government owned fixed line operator, and Albania’s privately owned wireless carriers, Vodafone, headquartered in the U.K., and AMC, an entity controlled by Greek telecom operators. If this information is verified, these relationships constitute a conspiracy between Albanian government officials and private sector telecom executives designed to defraud international callers to Albania. This should be of major concern to the FCC because a large percentage of this telephone traffic emanates from the U.S., and there is an adverse impact on American consumers. Furthermore, this could be just the tip of the iceberg because the situation in Albania may serve as an indication that similar acts of collusion exist between governments and private telephone carriers in other countries where U.S. calls are terminated.


    In September 2003, the International Telecommunications Union (ITU) issued a report on Albania’s telecom interconnection agreements that came to the conclusion that the fee sharing arrangements between Albtelecom and Albania’s two private wireless carriers were highly unusual. In brief, the report indicated that Albtelecom has been receiving a grossly lower percentage of the fees generated by each telephone call, and the wireless carriers were receiving an overly generous portion of the fees. In early December 2003, the ITU report was sent to the Albanian Regulatory Authority and the Ministry of Transport and Communications, but for some mysterious reason the ITU reports were “misplaced” and these government agencies did not bring the issue to the attention of Parliament or the Albanian public. This matter remained hidden within the Regulatory Authority and the Ministry of Transport and Communications until the publication in Albania of my February 3, 2004 letter to Vodafone Chairman Lord MacLaurin that requested an investigation of the interconnection agreements between Vodafone and Albtelecom. A summary extract of the ITU report is attached herewith.


    Seven months before the ITU report was issued, the U.S. government arrived at a similar conclusion. Unknown to the ITU and completely independent of its October 2003 report, the Central Eastern Europe Business Information Center (CEEBIC), an agency of the U.S. government that was established to promote economic development in Eastern Europe, issued a March 2003 report titled, “Telecommunications and Information Technology Albania.” A section of the CEEBIC report called “Backbones and Interconnection” stated,

     

     

    “Albtelecom is generating a big debt due to these abnormal interconnection agreements which have been signed and are in force.”


    As the FCC is aware, similar to domestic interconnection agreements, fees generated from international calls are shared among telecom carriers. Typically, the telecom carrier in the country where the call terminates would be entitled to a portion of the fee. In the case of Albania, as mandated by the government and by law, all international calls to and from Albania must pass through Albtelecom which is entitled to a percentage of the fee generated by the call.

     

     

    It is my understanding that telecom regulatory authorities from around the world provide information regarding their international traffic to Telegeography, a Washington-based organization that monitors this type of data. A source in Albania has informed me that Greek telephone traffic reports given to Telegeography indicated that in 2002 there were 105 million minutes of calls originating in Greece and terminating in Albania. In direct contradiction to this report, it appears that Albtelecom reported receiving only 85 million minutes of calls from Greece during this same period. The difference represents an amount of traffic equivalent to almost 30% of Albtelecom’s international business with Greece.

     

     

    How and why did 20 million minutes disappear? Are there similar irregularities with respect to Albania’s telephone traffic with the U.S.? Is it possible that international calls are being illegally diverted either before they reach Albania or within Albania? Why would Albtelecom, which has a state protected monopoly on international calls that terminate in Albania, share such a large percentage of the international interconnection fees with the two private wireless carriers? The answer to these and other questions may explain why calls placed by Americans to Albania are so expensive.

     

     

    According to the FCC web site and with regard to Albania, Albtelecom is still considered as a “carrier presumed to possess market power” in Albania, not Vodafone or AMC. This has implications for the termination rate paid to Albtelecom which will be lower than the rate paid to a carrier that is “assumed not to possess market power,” in this case Vodafone and AMC. A very likely reason is that Albtelecom is still the only “official” carrier for international traffic. Because U.S. operators do not have direct links with Vodafone and AMC, the U.S. carriers see only Albtelecom. The implication is that the Albanian government, via Albtelecom, in collusion with the Albania’s private wireless carriers, is engaged in a scheme which defrauds U.S. citizens and other international callers every time a call is placed to Albania.


    A major concern here is that senior Albanian government officials, who control Albtelecom, are in a position to provide sweetheart deals to the private wireless carriers in return for financial reward.


    The FCC should be aware that Albania is considered among the most corrupt countries in the world by Transparency International. You should also be aware that Members of the U.S. Congress at the Helsinki Commission hearing in Washington and Senior Officials of the European Union have recently issued stern warnings to the Albanian government in efforts to pressure them to curtail corrupt practices. Furthermore, a U.S. government agency is currently investigating Fatos Nano, the Prime Minister of Albania, for corrupt practices, including allegations that he maintains illegal foreign bank accounts. These circumstances, combined with the irregularities in Albania’s telecom sector that were exposed in the ITU and CEEBIC reports, make it clear that this matter should be addressed by the FCC.


    The FCC should also take into consideration the fact that the common stock of Vodafone is publicly traded in the U.S. and a high concentration of its shareholders are American financial institutions and citizens; therefore, Vodafone falls under the purview of the U.S. government via the Securities and Exchange Commission and most probably other agencies, including the FCC due to the fact that Vodafone is a major shareholder in Verizon Wireless.


    My efforts to bring this matter to the attention of the Albanian public forced the Albanian government to address this issue last year. Unfortunately, in the absence of any pressure being exerted by the U.S., the Albanian government conducted a sham investigation that was analogous to giving a fox the charge of guarding hens. A final resolution of this matter can only be accomplished by the U.S. government demanding that the Albanian government, the recipient of significant U.S. economic assistance, conduct a fully transparent investigation to include analysis of Albania’s domestic and international interconnection agreements and Albania’s international telephone traffic with the U.S. Because the requisite skills required for this task are unavailable in Albania, by necessity, such an investigation will require the participation of independent and objective outside auditors and industry experts.


    Because it appears that U.S. citizens are being defrauded every time a call is placed to Albania, I am requesting that the FCC open an investigation of this matter as soon as possible.

    1. Interconnection (I/C) agreements
    Interconnection agreements are available


    • between AMC/Vodafone and ABLTELECOM
    • between AMC and Vodafone
    • between ABLTELECOM and rural operators
    ABLTELECOM has been determined to have the Significant Market Power (SMP) status.


    The Albanian Telecommunications Act (art 42 item d ) states that “Organisations with Significant Market Power have the obligation to send copies of their interconnection agreements to TRE and make them available on request by interested parties (excluding commercially sensitive parts other than details of interconnection charges, terms and conditions)”. This means that interconnection agreements between AMC/Vodafone and ABLTELECOM and on the other hand between ABLTELECOM and rural operators should be available to all interested parties.


    The analysis of the interconnection situations was based on the current interconnection agreement documents and the discussion with the officials of the Albanian Telecommunications Regulatory Authority. No data for an in-depth analysis of the current interconnection situation were available.


    Problems with interconnection arrangements exist in two different categories:


    • in the interconnection between mobile operators (AMC and Vodafone) and the national fixed network operators ABLTELECOM
    • in the interconnection between ABLTELECOM and local rural fixed line operators
    The interconnection agreements include three types of problems:


    1. Legal problem
    The current Albanian Telecommunications Act (art 46) states “Interconnection fees must be cost oriented and cover effective cost using the network”. Both type of the above mentioned I/C agreements are based on charges by revenues sharing (sharing the fees paid by calling end users). Thus these I/C agreement are in conflict with the Telecommunications Act.


    1. Discriminatory / unbalanced fee structure
    The commercial terms of Vodafone / ALBTELECOM interconnection agreement (the AMC / ABLTELECOM interconnection agreement is exactly similar) indicate an unbalanced situation which sets ABLTELECOM in unfair position.

    Lexues të shumtë kanë kërkuar të dinë për çfarë letre bëhet fjalë në shkrimin e fundit të kryeredaktorit “Kush LUan me reformën”, kur përmendet edhe aktivisti i njohur shqiptaro-amerikan Geri Kokalari.

    DITA e posedon letrën që i është dërguar Ambasadës Amerikane në datën 8 shkurt 2015, personalisht Ambasadorit Donald Lu, asokohe i vendosur prej disa ditësh në Tiranë.

    Në letrën në fjalë, Kokalari fillimisht shkruan:

    “Ambasador Lu: Së pari, unë do të doja t’ju përgëzoj që më në fund morët postin e ambasadorit të SHBA në Shqipëri.

    Stafi i Ambasadës mund t’ju japë më shumë informacion për biografinë time, por përmbledhtas mund t’ju them se, që nga rënia e komunizmit, unë kam qenë i përfshirë në aspekte të ndryshme të çështjeve shqiptare, duke përfshirë edhe mbledhjen e ndihmave humanitare në Shqipëri dhe Kosovë, lobimin për ndërhyrjen amerikane në konfliktin e Kosovës, përkrahjen për ndryshime në institucionet demokratike të Shqipërisë dhe ekspozimin e praktikave korruptive në Shqipëri.     Aktivisti i njohur që kohët e fundit drejton edhe një organizatë me fokus Shqipërinë, zbulon më pas arsyet e letrës dërguar Ambasadorit. Ai shpreh fillimisht shqetësim për lidhjet e z.Lu me Frank Uisner që ka përfaqësuar Grupin Podesta dhe Patton Boggs të njohura si kliente të mëparshme lobingu të Berishës. Shkruan Kokalari:

    “…Pas fillimit të detyrës suaj si Ambasadori ynë, janë disa çështje që unë do të doja të sjell në vëmendjen tuaj në këtë letër. Sikurse ju tani jeni në dijeni, kur u njoftua së pari nominimi juaj, qarkulluan historira në mediat shqiptare që pretendonin se ju jeni emëruar si rezultat i ndërhyrjes së grupeve lobiste që punojnë për Sali Berishën, përfshirë Grupin Podesta dhe Patton Boggs, një firmë që përfaqësohej nga Frank Uisner. Kjo nuk ka nevojë për shumë imagjinatë, për faktin se ju keni shërbyer nën drejtimin e Uisnerit, kur ai ishte ambasadori amerikan në Indi, dhe të dy keni qenë studentë në Princeton. Sinqerisht, unë kam pak konsideratë për Uisnerin, pasi besoj se ai ishte në përgjithësi një faktor keqdashës në Shqipëri. Sipas mendimit tim, ai ndihmoi Berishën në mbajtjen e një regjimi shumë të korruptuar që rrënoi shtyllat e demokracisë…”

    Në letrën e tij që ndodhet tashmë në duart e ambasadorit të ri, Kokalari shton dozën e dyshimeve për z.Uisner duke e lidhur edhe me faktin që sipas tij, Patton Boggs dhe Uisner luajtën një rol kyç në dhënien e tenderëve të ARMO-s dhe Albpetrol-it.

    “Të dy këto transaksione doli të ishin shumë të dëmshme për Shqipërinë, pavarësisht nga fakti që unë i kisha dhënë paralajmërime të mjaftueshme për to Ambasadës, se këto marrëveshje ishin të dënueshme që në fillim, siç kam bërë në rastin e fiaskos së New World Telecom. Për fat të keq, në përgjithësi, Ambasada ka dështuar të veprojë sipas paralajmërimeve të mia…” – shkruan ai.

    Kokalari shton më tej se edhe Uisner edhe ambasadori i mëparshëm i SHBA në Tiranë kanë marrë prej tij emaile mbi këtë çështje. Ai pranon se ka kontaktuar disa herë Komitetin për Marrëdhënie me Jashtë të Senatit i shqetësuar nëse Uisner ka ndikuar për kandidaturën e z.Lu në Tiranë duke patur parasysh lidhjet e tyre të mëparshme.

    Kokalari shkruan:

    “…Për shkak të shqetësimit tim rreth aludimeve që palët me konflikte të rënda interesi, si Uisner, mund të kenë ndikuar në mënyrë të papërshtatshme pro nominimit tuaj, unë kontaktova disa herë Komitetin për Marrëdhënie me Jashtë të Senatit në periudhën qershor- shtator 2013 për ta shprehur këtë shqetësim. Unë gjithashtu kërkova që anëtarët e Shqiptarëve për një Shqipëri Demokratike të komunikojnë me anëtarët e Kongresit për të regjistruar shqetësimet e tyre. Si rezultat i komunikimit tim kompjuterik me Komitetin për Marrëdhënie me Jashtë të Senatit, u informova nga një anëtar i stafit të Komitetit që ju ishit pyetur në lidhje me këtë çështje gjatë seancës dëgjimore për emërimin në shtator 2013. M’u tha gjithashtu se ju ishit i tronditur disi nga kjo linjë e marrjes në pyetje, por ju mohuat se kishit dijeni që lobistë të qeverisë së Berishës të kishin ndikuar në emërimin tuaj…

    Po e marr për të mirëqenë këtë që keni thënë ju. Kjo do të thotë se, tani që ju jeni ambasadori ynë në Shqipëri, unë duhet t’ju them se besoj që do të ishte shumë e papërshtatshme për ju që të bashkëpunoni me Uisnerin në çfarëdo niveli sa i përket çështjeve që shqiptarët janë të interesuar. Sipas mendimit tim, Uisner nuk është veçse një trafikues influencash, dhe nuk do të çudisë kërrkënd nëse Berisha përpiqet të përdorë marrëdhëniet e tij me Uisnerin për të ndikuar tek ju me qëllim që të ripozicionojë veten e tij për të rimarrë pushtetin në Shqipëri…”

    Kokalari shton më poshtë në letër se do kontaktojë Uashingtonin nëse do të merret vesh se Uisner me ndonjë mënyrë tenton të përzihet në punët e Shqipërisë duke përfituar nga marrëdhëniet e tij me ambasadorin:

    “Natyrisht, ju keni të drejtë për të mbajtur një marrëdhënie personale me Uisnerin, dhe ka të ngjarë që gjatë disa viteve të ardhshme ju do të keni përvoja të pakëndshme në lidhje me Berishën, një të urryer, të korruptuar, bandit mendërisht të paqëndrueshëm. Megjithatë, unë dua të deklaroj prerazi se në qoftë se do të merret vesh se Uisner me ndonjë mënyrë tenton të përzihet në punët e Shqipërisë duke përfituar nga marrëdhëniet e tij me ju, unë nuk do të hezitoj për ta adresuar një aktivitet të tillë me zyrtarët e duhur qeveritarë në Uashington, dhe do të inkurajoj shqiptaro-amerikanët që të bëjnë të njëjtën gjë. Sepse unë besoj se çdo veprim i tillë nga ana e juaj, do t’i vërë në dyshim rrethanat në të cilat ju jeni emëruar dhe do të ishte e dëmshme për interesat shqiptare dhe amerikane – shkruan ndër të tjera ai në letrën dërguar Ambasadorit.

    Ai shpreh gjithashtu shqetësim për një takim, të z.Lu, të cilin e ka përmendur edhe më parë në dhjetorin e vitit te kaluar. Shkruan Kokalari:

    “…Në lidhje me një tjetër çështje, unë kam qenë shumë i shqetësuar kur mësova se në 2 Dhjetor 2014, si një prej veprave të tua të para, pasi u konfirmuat si Ambasador, jeni takuar në Uashington me përfaqësues të Shoqatës së Himariotëve të Amerikës (HSA), një grup i vogël ngatërrestar grek (http://himarriotonsociety.org/content/news/hsa-meets-new-us-ambassador-albania-donald-lu). Misionet më të fundit të HSA dhe palëve të tjera trazovaçe greke janë identike: aneksimi nga Greqia e asaj që ata mendojnë të jetë territor grek në jug të Shqipërisë. Misioni i tyre mbështetet mbi pasaktësi historike të shkuara dhe të sotme. Me fjalë të tjera, themeli i besimeve të tyre është e ndërtuar mbi mite greke.

    Ju duhet të jetë i vetëdijshëm se objektivat e HSA dhe kolegët e tyre ngatërrestarë grekë janë në kundërshtim të drejtpërdrejtë me interesat e shqiptarëve në Shqipëri dhe në diasporën tonë në Amerikë, për të mos folur për faktin se këto keqinterpretime minojnë interesat strategjike të Amerikës në rajon…”

    Kokalari përmend si precedent rastin Gejxh:

    “Për dijeninë tuaj, në 2002, ambasadori i atëhershëm i SHBA, Xhejms Xhefri, në mënyrë të papërshtatshme priti Nikolas Gejxh në Tiranë, dhe për shkak të aktivizmit anti-shqiptar të Gejxhit, “shtrimi i tapetit të kuq” enkas për Gejxhin nga Ambasada u pa si një fyerje e rëndë nga shqiptarët. Gejxh është një ngatërrestar i mirënjohur grek, i cili së bashku me të tjerë të takëmit të tij, si kolonel Janullatos, promovojnë agjenda zjarrvënëse për tensionet mes Shqipërisë dhe Greqisë. Si reagim ndaj incidentit të Gejxhit, unë kam luajtur një rol kyç në hartimin dhe dërgimin e letrës së 9 janarit 2003 drejtuar Sekretarit të Shtetit Kolin Pauell (http://www.alb-net.com/pipermail/prishtina-e /2003-January/000583.html).

    Si rezultat i kësaj letre, Departamenti i Shtetit i kërkoi ambasadorit Xhefri të takohet me udhëheqës të komunitetit Shqiptaro-Amerikan në Nju Jork. Në atë takim, Xhefri kërkoi falje për gabim në protokoll, dhe për justifikim, ai pohoi se nuk ishte në dijeni të ndjenjave të shqiptarëve ndaj Gejxhit dhe ndjekësve të tij. Sinqerisht, unë nuk e besova ambasadorin Xhefri as atëherë as tani. Por për shkak të atij episodi, unë e bëra atë si zakon timin të njoftoj çdo Ambasador që pasoi Xhefri në lidhje me këtë çështje, kështu që nuk mund të ketë asnjë konfuzion ose keqkomunikim në këtë drejtim për të shkuar përpara. Letra e 9 janarit për Pauellin duhet të shërbejë si njoftim për ju se pretendimet e palëve ngatërrestare greke janë joserioze në rastin më të mirë, për të nxitur destabilitet në Ballkan në rastin më të keq, dhe se shqiptarët do t’ju shohin me dyshim të thellë në qoftë se ju ndihmoni ose nxisni këto palët ngatërrestare në ndonjë mënyrë. Ju lutem kuptojeni se duke lehtësuar ambiciet e tyre, ju do të shërbeni vetëm për të minuar marrëdhëniet SHBA-Shqipëri… – lexohet në letrën drejtuar ambasadorit Lu.

    Në fund të letrës Kokalari i tërheq vëmendjen ambasadorit mbi faktin që në Shqipëri fjala e Ambasadës Amerikane dëgjohet shumë dhe i kujton që nga fuqia e madhe, vjen përgjegjësia e madhe.

    “…Qëkurse shqiptarët e shpëtuan veten nga prangat e komunizmit, shumë ambasadorë kanë ardhur dhe shkuar. Por një gjë ka mbetur konstante: Unë kam vazhduar të mbroj atë që unë besoj se është më e mira në interes të shqiptarëve, pavarësisht politikave dhe veprimeve të Departamentit të Shtetit. Për kujtesë, unë mund të them i bindur se makinacionet e të dërguarve tanë nuk kanë qenë gjithmonë në interesin më të mirë të shqiptarëve apo interesave strategjike të Amerikës. Unë preferoj që të punojnë në frymën e bashkëpunimit të ndërsjellë, por ju lutem ta dini se unë nuk do të hezitoj për të kritikuar politikën e Departamentit të Shtetit në Shqipëri, kur të jetë e nevojshme ose të lidhem me ju në lidhje me çështjet që unë besoj se kërkojnë vëmendjen tuaj.

    Në fjalët e Volterit dhe të Njeriut Merimangë, “Nga fuqia e madhe vjen përgjegjësia e madhe”. Ju padyshim do ta kuptoni edhe vetë se pozicioni juaj si Ambasador i SHBA në Shqipëri ju jep pushtet të madh, ndërsa ju jeni në Shqipëri, çka mund të jetë unike brenda trupit diplomatik të Amerikës. Kjo është për shkak se ka pak, nëse ka, vende në botë, ku fjalët dhe veprat e një Ambasadori Amerikan vëzhgohen nga afër dhe respektohen, siç është rasti në Shqipëri. Unë shpresoj që ju do të përdorni këtë fuqi me përgjegjësi për shkak se ju do ta kini mësuar tashmë se ka pak, nëse ka, vende në botë ku Amerika është e admiruar kështu (https://europeansouth.wordpress.com/2007/06/19/albanias High-lidhje-për-america-ka-a-gjatë-histori /).
